Labor ministry makes it mandatory to hire workforce only under Labor Act

Issuing a press statement on Friday, the ministry said it has received complaints that doctors, health workers, nursing staff, and employees in various institutions—including hospitals—are being hired without proper contracts and are often made to work beyond legally permitted hours.

KATHMANDU, April 17: The Ministry of Labour, Employment and Social Security has urged all concerned parties not to employ workers without formal employment contracts in line with the Labour Act, 2074.



Issuing a press statement on Friday, the ministry said it has received complaints that doctors, health workers, nursing staff, and employees in various institutions—including hospitals—are being hired without proper contracts and are often made to work beyond legally permitted hours.

The ministry clarified that under Section 2 (da) of the Labour Act, an “employment agreement” refers to a contract between an employer and worker outlining service conditions, terms, and benefits, and includes appointment letters issued by employers.


The law allows a maximum of eight working hours per day and 48 hours per week. Overtime work is permitted only up to four hours per day and 24 hours per week, and must not be enforced beyond legal limits.


The ministry has warned that any violation of these provisions will result in legal action under the Labour Act, 2074, and urged strict compliance with existing labor laws.
