KATHMANDU, May 27: The National Human Rights Commission (NHRC) has recommended a detailed investigation into possible collusion between Rastriya Swatantra Party (RSP) chair Rabi Lamichhane and the then jailor in the Nakkhu prison “jailbreak” incident that took place during the Gen-Z protests on September 8 and 9.
Based on a report prepared by a committee coordinated by NHRC member Dr Lily Thapa, the commission has stated that the process of Lamichhane’s release from Nakkhu Prison in Lalitpur may involve criminal wrongdoing and has called for investigation and legal action.
According to the NHRC, the recommendation has already been submitted to the Office of the Prime Minister.

At the time of the incident, Lamichhane was in custody at Nakkhu Prison. During the protests, a large crowd including then-RSP lawmakers Manish Jha and Hari Dhakal reportedly surrounded the prison, after which Lamichhane was released citing security concerns.
The NHRC report states that the act of being released from prison in an unauthorized manner is not only a violation of human rights but may also constitute a criminal offence under Section 49 of the Prison Act 2079. It calls for a detailed investigation into the involvement of Lamichhane, then jailor Satyaraj Joshi, and other RSP leaders.
The NHRC has also raised concerns that there appears to be inconsistency between the statements of the jailor and Lamichhane regarding the circumstances of the release, suggesting possible coordinated pressure or agreement.
It further noted that immediately after the incident, other inmates escaped from the same prison, raising additional questions about the security situation.
The NHRC has recommended that the government conduct a thorough criminal investigation and take action against all individuals found responsible, including Lamichhane and the former jailor.
